Super busted at Target (again)

So I got busted at target about a month ago, the guy basically said we got a complaint and if we get more we will have to do something. This time it was less relax of a bust. The guy was in a normal sweatshirt and jeans, came up to me while I had my knuckles on the floor capturing a perfect latina who was squatting down. I usualy wouldn’t go for this angle but the ass was the best I’ve seen in months and I just had to. I also capped her as she was walking in as we walked in together, I’m thinking this is where I raised suspicion maybe, or the girl in the makeup area who was working busted me and told security. Either way, I usually would be more patient and less aggressive while capturing but I spent the whole day at mexican supermarkets and got a lot of good footage and the security there is basically non existant. So being in Target I should have known they watch the cameras like hawks. I was a bit careless, yes it’s my fault but in the moment I didnt care I wanted to get every angle I could on this ass. I will post her in near future.

Here is how the bust went, Guy came up to me saying “hey my man how’s it going” I replied hey good, he then said “so you like butts?”. I said what and he repeated it a few times then I said “butts?” He then said yeah man I already know what you’re doing so you can either delete all the footage off your phone right now or i’ll call PD. I said but my phones not even on look my screen is black, and he said “I dont care. I have the information I need I’m just asking you what you now want to do.” So I caved and went to my gallery and delted everything (knowing it was in the recently delted I wasnt worried). Then he said “No, you need to show me what you filmed in here.” I definitely was not going to do that so I just started walking out. He then talked on his walkie talkie saying “Go ahead and call them, get his license plate.”

I’m guessing he has to see the footage to confirm it in order to ban me or get PD involved? Even if they did get my license plate I don’t think they would do anything.

Before you guys lecture me, I’ve been capping for years, just recently been more aggressive and careless, I know what to do and what not to do and yes I was stupid. How’s this though, I left that target, drove about 15 mins. Went into another target and started capping. LMAO. I definitely have to avoid that target for at least a year or whenever that retard stops working there I guess. It’s not illegal but I’m sure Target can ban me.

Should I just have denied completly. I denied but eventually caved in because he said if you delete it all now we will be fine. But after I did that he wanted to see the footage that’s where I knew something was up. I never showed him anything. I’m guessing I should have acted like he was crazy and never admitted anything yeah? Even though he caught me with my knuckled on the ground, phone in hand, right behind an insane latina bbl that was squatting lmao. I was really scared but now I’m guessing I just avoid that specific Target (shame cuz it’s in a great spot for latina bbl’s.)

You deescalated the situation, and left the what would be scene. The black screen worked to the point he may have needed proof for the possible illegal filming. Doesn’t matter what anyone says after that. So, I would however go to that Target but NOT shoot (or have evidence on the phone), I wouldn’t take the phone out the pocket, go real shopping.

I’d just avoid that particular store and nearby ones for a bit. I think you handled it well all things considered; it’s always harder in the moment to mount a defence when you’re caught red-handed, but you didn’t give up any evidence. That’s the main thing. Screen was off too so security guard has no evidence, just a (reasonable) amount of suspicion.

As for lecturing? Nah bro, your reputation speaks for itself so anyone coming here to criticise can offer something constructive or keep their mouth shut. You got too aggressive and got caught out, mistakes happen. You already know where you went wrong so nobody knows better than you how to either a) avoid that or b) overcome it with new techniques.

There’s always a risk with this shit we do. We’ve got guys taking snaps from across parking lots and complaining their posts don’t stay up, but the simple truth of capping is “the greater the risk, the better the haul.” Lay low for a bit and give yourself time to reset and regroup.

Oh and I wanna see this ass too, I know it was worth it LMAO

The only thing I would not have done was go straight back to my car to prevent them from getting the license plate. I would have gone to some other shops or for a walk around the block and collected my car later.

Never show anyone anything on your phone they have less than zero right to look at it. Deny deny deny. Target has “evidence” in the way of their security cameras, which will show a guy putting a camera in a girls butt but still don’t let them see your phone.

Sounds dramatic but the cops actually need a search warrant to look at your phone if they want to. In this situation if they got called they probably would have filed charges on you but it wouldn’t go anywhere. Technically legally what goes on here is “accosting the opposite sex” if you get caught, which isn’t serious at all its just embarrassing and a hassle to go through. Not something the cops would search your phone for tho, I mean unless its like a repeat offender type of thing but guys who get caught here seem like one offs. I wouldn’t ever go back their tbh not worth any risk. (I have a little legal knowledge)

As long as you there are no up skrts, it is legal to take pictures of anything you want. (As long as the subject matter isn’t a minor).The worst they can do is ask you to leave. He asked you to show him the footage because he believed there were up skrts on it. And without it, he has no proof that you are doing anything illegal. You didn’t even have to show him the photos, so next time, don’t. No one is allowed to see whats on your phone without a search warrant. The best thing to do is always deny everything at all costs and leave the store. His threatening to get your license plate is only a measure to intimidate you, there is nothing legal that can be done. If there is valid evidence that suggests you are taking up skrts, you could be later questioned by the police if they care enough. Other than that, merely taking pictures of butts is completely legal as long as it’s not in a private bathroom or changing room or of a minor. I would lay low from all Targets for at least 6 months. By then, the staff will have changed over and likely lost interest.

But dude seriously, caught again? Target are hounds! Especially in the make-up section cmon bro! You getting caught just adds to the heat of us and other candid shooters who try their best to stay undetected.

Next time, and I hope there isn’t a next time, just get up and walk out. You’re not stealing, and no crime was committed, they can’t hold you there so just leave without communicating.

Also - if the rare case the cops DO show up to your place or question you. DENY everything. If they wanna talk to you - that means that DONT got SHIT. If they had proof - you would be arrested arleady. NEVER TALK TO POLICE - DENY DENY DENY

I worked at Target and AP is scum. Wannabe cops that failed the police test. The fact that he wanted to see the footage makes me believe he wasn’t 100% not sure you were doing it. As long as you don’t admit anything and refuse to discuss situations/deny it, you are good. The biggest thing is even if they act like they caught you red-handed, never confess to shit. The majority of dudes in general get fucked by the cops bc their own stupidity in talking. Target has really good facial ID cameras. Maybe just wear a hat and glasses/mask until this cools down. !

What you said isn’t entirely true.

I’m a professional photographer who used to work for a media organization. They had their legal team meet with me to discuss my strategy and to give me the basic facts I would need to keep the company from getting sued. Here’s my understanding of what they told me about public photography in the USA:

You can not film someone without their permission in any place where there is a reasonable expectation of privacy. This means inside their own homes, back yards, private property, inside a bathroom, a fitting room, locker room, or any area where the subjects would assume they have some privacy.

Private property falls under a different category. It may be a space that’s accessible to the public, like a mall or shop, but the owner of that property reserves the right to have you removed for any reason. Following women around the store is contributing to a negative experience for the customers, so they have every right to kick you out. Rent-a-cop may not legally see what’s on your camera, but the real police can, and will if they are called in.

Keep in mind that many big box stores and malls do not allow photography or videography within their property. Some are kind enough to list these rules on their websites, so if you’re not sure check there.

Property owners can still file a trespass complaint against you if you continue to frequent their stores after being kicked out. You could find yourself with a criminal trespass charge. A charge which could get you arrested and cost you a heap of money in court & lawyer fees.

Private property is NOT the same thing as public property. You might be “in public” while in Target, but you’re not IN PUBLIC. The more accurate thing to say is that you are “amongst the public” occupying space in private property that is “open to the public.”

Sorry for the long text, but this is important to understand. Anyway, I’m not an attorney so check your local laws, consult an attorney, etc.

While Target does not expressly prohibit filming in their stores, they ask that you seek the store management’s approval before doing so:

a few others have said similar but basically the answer is this:

  1. if they had enough “evidence” to arrest you, they would have - they aren’t “being cool guys”
  2. creeping in public is “creepy” but not illegal, the best the police could do is issue a trespass, or perhaps “disorderly conduct” (in Canada USA UK and a few others)

they have no right to search your phone, ask you to erase anything or make you unlock it, or anything with your private property… even police need a warrant to look in your phone (they’ll try though)
the point is, never let them, never unlock or delete it yourself, doing so could be seen as an admission of guilt, and could be used against you.

otherwise, stay away for a bit… you’ll be fine.

Cops can look through your personal property without a warrant if they suspect you are in the process of committing a crime. (ie, the cop can search your car without a warrant if he pulls you over and smells marijuana).

I suggest all of you do your own research here.

Don’t always count on cops being too busy to deal with a friendly neighborhood pervert at Target. Cops get bored, and since they aren’t allowed to bust real criminals they might be more than a bit excited to ruin your day.

Just be safe out there, don’t get caught, understand the risks you are taking, don’t talk to the police, and remember: the question “am I being detained?” is not a magic incantation that causes police to let you go.
